Consent orders comprise of the agreement reached between the two parties in the dispute. The consent orders clearly set out all assets and ‘who gets what’.
Consent orders provide finality, as both parties know that the orders cannot be changed except by the court. Any breaches in orders are dealt with by the court.
Once consent orders are agreed upon, a Form 11 for Consent Orders must be completed and filed at the court within 2 months of both parties signing the orders.
You can complete consent order forms on your own, however, to ensure that assets are divided fairly and all legal requirements are met, it is best to obtain the advice of a legal practitioner.
