Robbery Causing Wounding to the Victim

Stealing from the person involves robbing, assaulting, stealing chattels or other valuables from another person, without the use of any weapons. During this, the victim is not harmed.

Section 96 of the Crimes Act (NSW) 1900 states that if someone commits robbery or stealing in circumstances of aggravation and wounds or inflicts grievous bodily harm on any person they can be imprisoned up to 25 years.

In order to be charged with robbery causing wounding to the victim, grievous bodily harm must be inflicted on any person. Grievous bodily harm includes:

  • The destruction (other than in the course of a medical procedure) of the foetus of a pregnant woman, whether or not the woman suffers any other harm, and
  • Any permanent or serious disfiguring of the person, and
  • Any grievous bodily disease.

An example of this offence is robbing a pregnant woman of her handbag and pushing her over causing her to lose her baby.

Penalty

The maximum penalty for robbery causing wounding to the victim is 25 years imprisonment.
