A client was recently charged with street racing. The allegations were that he raced his friend from a set of lights. Both were on motor bikes.
On our advice, the client pleaded “not guilty” to the charge. He was an overseas resident, but could not afford a conviction for the type of offence due to his career aspirations. With the client living overseas, communication with the client was limited and preparation for the matter a little strained. The client flew in from overseas for the hearing of his matter.
Although police in car video footage showed my client accelerate harshly from the traffic lights to the point where his front wheel lifted off the ground, and his friend likewise accelerated harshly, both riders were deemed by the Magistrate to have been speeding. However the Magistrate accepted the submissions that the police case did not go far enough to prove the charge of street racing and dismissed the charge.
Our client was found 'not guilty' and the street racing charge dismissed.
