Our client was a young man who had a series of 3 major traffic offences that occurred within several months of each other. He had completed almost 3 years of licence disqualification and had managed to remain employed in his trade despite this restriction.
As a result of the 3 major traffic offences he had committed, our client faced a further 5 year disqualification as he had been declared a habitual offender by the RTA. This further 5 year would make it difficult for our client to be able to move on in his life, finish his tertiary education course and have a more secure job future. We made an Application to a Local Court to have the Habitual Offender Declaration quashed using character references which demonstrated the progress that he had made in his attitude towards driving.
The Declaration was determined to be unjust in all the circumstances and our Application was successful. The 5 year further disqualification period was therefore quashed.
