A client was referred to me for a high range drink driving matter, where he drove through the front fence of a house and tried to flee the scene in the process. The charging police officer advised him not engage the services of a solicitor and send in a “written pleading” attached to the Court Attendance Notice. Thankfully, he made the right decision and obtained our legal services.
After taking detailed instructions from the client, we engaged the services of a pharmacologist, who prepared a report suggesting that the client’s blood alcohol level was possibly below the high range at the point of driving. Although the report was not strong and may have not held up in Court, I managed to convince the police that their case was likely to fail and so they reduced the charge from high range to middle range, to which the client pleaded guilty.
Instead of the client pleading guilty to high range rink driving and facing the likely automatic period of licence disqualification (due to also having an accident and trying to flee the scene) which was 3 years and a possible $3,300 fine, after being patient and being prepared to do some hard work, I obtained for him a licence disqualification of only 8 months and a $700 fine.
