Employee's Duty Not to Compete with Prior Employer

Employee obligations to their employers do not cease upon termiantion of employment. A duty owed by employees to their former employers is a duty not to compete with them.

It is not illegal to establish a business in competition with your former employer, however, a duty of loyalty to your former employer, to refrain from competition does exist. Employees will usually be required to obtain their employer’s express and informed consent to compete with them. Terms establishing a duty not to compete are usually included within the original employment agreement.
