Your basic rights are set out within your Modern Award or Enterprise Agreement. The protection for employees in place provides for the transfer of such instruments from your old employer to your new employer. Such agreements can cover you for up to 3 months after you commence working with your new employer. With high income transferring employees, the guarantee of earnings has effect after the transfer time as if it had been given by the new employer, but the new employer is not required to comply. In terms of non-monetary benefits, if it is not practicable for your employer to provide them, then you are to be compensated by money.
