National Employment Standards: Personal, Carers and Compassionate Leave

Personal Leave

Under the National Employment Standards, all employees with the exception of casual employees, are entitled to 10 days of personal leave per year. Personal leave is taken when the employee is unfit to work due to a personal illness or if caring for or supporting a member of their immediate family.

Unpaid Carer’s Leave

Employees are entitled to 2 days of unpaid carers leave per occasion. The reason for the leave must be personal illness or unexpected emergency of a member of the employee’s family. You cannot take unpaid carer’s leave if paid personal leave is still available.

Compassionate Leave

Employees can take 2 days of compassionate leave per occasion that leave is required due to the life-threatening illness or injury of a family member or if there is a death in the family. Compassionate leave may be taken to spend time with the family member or with family after death.
